4. Eligibility

Hyko.ai offers multiple subscription tiers:

Free Plan: Up to 2 agents, 10 MB storage, 100 credits - €0.00
DIY Plan: Up to 5 agents, 5 GB storage, 1000 credits - €49.99/month
PRO Plan: Unlimited agents, 15 GB storage, 5000 credits - €199.99/month
Custom Plan: Custom agents, storage, and credits with priority support - Custom pricing

6.2 Credit System

Hyko operates on a credit-based system. Credits are consumed when using AI agents and their various capabilities. Credit allocations vary by subscription plan. Credits included in subscription plans are valid for the duration of your active subscription. One-time credit purchases are valid for one year from the date of purchase.

6.3 Billing and Payments

Subscription fees are billed monthly in advance
All fees and credit purchases are non-refundable except as required by law
We reserve the right to change pricing for credits or services at any time, without prior notice
Your continued use of the platform constitutes acceptance of any price changes
Failure to pay may result in service suspension or termination

6.4 Third-Party Payment Processors

BIGmama Technology uses third-party services to process payments. By making a payment on Hyko.ai, you authorize us to share necessary information with these third-party services. We are not liable for any issues arising from these services, including errors, disruptions, or security incidents.

7. Acceptable Use Policy

You agree to use Hyko's services only for lawful purposes. You agree not to:

Use the Service for any illegal purpose or in violation of any laws or regulations
Exploit, harm, or attempt to exploit or harm minors in any way
Infringe upon intellectual property rights of others
Upload or transmit viruses, malware, or harmful code
Attempt to gain unauthorized access to our systems, networks, or data

Scrape, harvest, or collect data from the Service without permission
Create AI agents that harass, abuse, or harm others
Generate content that is defamatory, obscene, or hateful
Violate the terms of service of third-party platforms integrated with Hyko.ai
Impersonate BIGmama Technology, its employees, or any other person or entity
Interfere with or disrupt the integrity, performance, or security of our services
Engage in any form of reverse engineering or unauthorized data scraping on the platform
Use Hyko's services in any manner that could damage or impair the platform

8. Content and User Responsibility

8.1 Your Content

Hyko allows users to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You retain all rights to content you upload, create, or generate using the Service. You are responsible for all Content you post and agree that it complies with applicable laws, privacy rights, and intellectual property rights.

8.2 License to Use Content

By posting Content on Hyko.ai, you grant BIGmama Technology Ltd. a worldwide, non-exclusive, royalty-free license to use, store, process, display, and share your Content on or through our platform as necessary to provide and improve our services.

8.3 Content Removal

We reserve the right to remove any Content that violates these Terms without prior notice.

8.4 AI-Generated Content

Content generated by AI agents using the Service may be owned by you, subject to applicable laws and these Terms. You are responsible for ensuring AI-generated content complies with all applicable laws and does not infringe third-party rights.

8.5 Our Intellectual Property

The Service, including all software, algorithms, designs, trademarks, and documentation, is owned by BIGmama Technology Ltd. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Knowledge Library and Data Storage

9.1 Storage Limits

Storage limits vary by subscription plan:

Free: Up to 10 MB
DIY: Up to 5 GB
PRO: Up to 15 GB
Custom: Custom storage

We reserve the right to delete or restrict access to content that exceeds your plan's storage allocation.

9.2 Data Responsibility

You are responsible for:

The accuracy and legality of documents, images, and videos uploaded to your knowledge library
Ensuring you have necessary rights and permissions to upload content
Maintaining backups of important data

10. AI Agents and Automation

10.1 Agent Limits

The number of agents you can create depends on your subscription plan:

Free: Up to 2 agents
DIY: Up to 5 agents
PRO: Unlimited agents
Custom: Unlimited and custom agents

Agent activity is subject to credit consumption and fair use policies.

10.2 Browser Automation

When using browser automation features, you agree to:

Comply with the terms of service of websites your agents interact with
Not use automation for unauthorized access or data scraping
Respect robots.txt and other access restrictions

10.3 Agent Behavior

You are responsible for the actions and outputs of AI agents you create. We are not liable for agent errors, inaccuracies, or unintended consequences.

11. Third-Party Integrations

The Service may integrate with third-party platforms and services. Your use of such integrations is subject to the respective third-party terms of service. We are not responsible for third-party services or changes to their availability.

12. Monitoring and Analytics

To enhance our services, we may use third-party providers to monitor and analyze user activity on Hyko.ai. Our use of analytics services may involve collecting data on usage, interactions, and other metrics. All data is managed in accordance with our Privacy Policy.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT AI AGENTS WILL PRODUCE ACCURATE OR RELIABLE RESULTS.

15. Limitation of Liability

BIGmama Technology Ltd. is not responsible for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of Hyko.ai, including any data loss, downtime, interruptions in service, loss of profits, revenue, data, or business opportunities.

You agree that the maximum liability of BIGmama Technology Ltd. for any claim related to your use of the platform will be limited to the total amount you have paid to us in the twelve months preceding the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless BIGmama Technology Ltd., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms

Content created by your AI agents
Content you post on the platform

17. Termination

You may terminate your account at any time through account settings or by contacting us. Termination does not entitle you to a refund of prepaid fees or purchased credits.

We may suspend or terminate your access to the Service immediately, without prior notice, if:

Your account has been inactive for an extended period
We are required to do so by law
Continuing to provide Service creates risk or legal liability

17.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete Your Content after a reasonable grace period. Provisions that by their nature should survive termination will remain in effect.
